Explanatory Note
CLAUSE 1: [Land Title Act, section 222]
- provides that a covenant that, directly or indirectly, restricts the
sale, ownership, occupation or use of land in a manner that is contrary
to section 7 of the Human Rights Code is void and of no effect; and
- requires the registrar to take certain actions in respect of them.

LAND TITLE AMENDMENT ACT, 2023
HIS MAJESTY, by and with the advice and consent of
the Legislative Assembly of the Province of British Columbia, enacts as
follows:
1 Section 222 of the Land Title Act, S.B.C. 1996, c. 250, is repealed and the following substituted:
Discriminating covenants are void
222 (1) A covenant that,
directly or indirectly, restricts the sale, ownership, occupation or use
of land in a manner that is contrary to section 7 of the Human Rights Code is void and of no effect.
(2) The registrar must cancel and remove a covenant referred to in subsection (1).
(3) If the registrar has notice that a registered
restrictive covenant is void under this section, the registrar must, on
the registrar's own initiative, remove the covenant.
Commencement
2 This Act comes into force on the date of Royal Assent.
