 Explanatory Notes

CLAUSE 1: [Protected Areas of British Columbia Act, Schedule A] enacts in Schedule A of the Act descriptions of several ecological reserves previously listed in Schedule B of the Act as ecological reserves established by Orders in Council.

CLAUSE 2: [Protected Areas of British Columbia Act, Schedule B] removes ecological reserves added by this Bill to Schedule A of the Act.

CLAUSE 3: [Protected Areas of British Columbia Act, Schedule C]

  • repeals the description of Kilby Park;
  • changes the descriptions and sizes of Cinnemousun Narrows Park, Kiskatinaw Park, Naikoon Park and Skagit Valley Park.

CLAUSE 4: [Protected Areas of British Columbia Act, Schedule D]

  • changes the names of Enderby Cliffs Park and Maquinna Marine Park to Indigenous names;
  • changes the descriptions and sizes of Maquinna Marine Park and Wells Gray Park.

CLAUSE 5: [Rescission of ecological reserves] rescinds the establishment by Orders in Council of several ecological reserves, the descriptions of which are added by this Bill to Schedule A of the Act.

PROTECTED AREAS OF BRITISH COLUMBIA
AMENDMENT ACT, 2025

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1 Schedule A of the Protected Areas of British Columbia Act, S.B.C. 2000, c. 17, is amended by adding the following descriptions:

COLUMBIA LAKE ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Kootenay District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 12 Tube 2013. The whole ecological reserve containing approximately 42 hectares.

FRASER RIVER ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in New Westminster District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 2 Tube 2014. The whole ecological reserve containing approximately 191 hectares.

NECHAKO RIVER ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cariboo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 13 Tube 2014. The whole ecological reserve containing approximately 131 hectares.

PARKER LAKE ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Peace River District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 14 Tube 2014. The whole ecological reserve containing approximately 259 hectares.

RACE ROCKS ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Metchosin District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 15 Tube 2015. The whole ecological reserve containing approximately 240 hectares (2 hectares of upland and 238 hectares of foreshore).

SKAGIT RIVER RHODODENDRONS ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Yale Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 5 Tube 2015. The whole ecological reserve containing approximately 75 hectares.

TACHEEDA LAKES ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cariboo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 7 Tube 2015. The whole ecological reserve containing approximately 504 hectares.

VANCE CREEK ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Osoyoos Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 11 Tube 2015. The whole ecological reserve containing approximately 40 hectares.

2 Schedule B is amended

(a) by striking out "Columbia Lake Ecological Reserve, established by Order in Council 1582/71",

(b) by striking out "Fraser River Ecological Reserve, established by Order in Council 660/77",

(c) by striking out "Nechako River Ecological Reserve, established by Order in Council 3765/75",

(d) by striking out "Parker Lake Ecological Reserve, established by Order in Council 1829/73",

(e) by striking out "Race Rocks Ecological Reserve, established by Order in Council 692/80",

(f) by striking out "Skagit River Rhododendrons Ecological Reserve, established by Order in Council 2318/81",

(g) by striking out "Tacheeda Lakes Ecological Reserve, established by Order in Council 3276/72", and

(h) by striking out "Vance Creek Ecological Reserve, established by Order in Council 466/72".

3 Schedule C is amended

(a) in the description of Cinnemousun Narrows Park by striking out "Plan 9 Tube 1912" and substituting "Plan 10 Tube 2028" and by striking out "The whole park containing approximately 738 hectares (536 hectares of upland and 202 hectares of foreshore)." and substituting "The whole park containing approximately 584 hectares.",

(b) by repealing the description of Kilby Park,

(c) by repealing the description of Kiskatinaw Park and substituting the following:

KISKATINAW PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Peace River District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 1 Tube 2029. The whole park containing approximately 55 hectares. ,

(d) in the description of Naikoon Park by striking out "Plan 3 Tube 2024" and substituting "Plan 4 Tube 2029" and by striking out "The whole park containing approximately 69 149 hectares (67 039 hectares of upland and 2 110 hectares of foreshore)." and substituting "The whole parking containing approximately 69 320 hectares (67 210 hectares of upland and 2 110 hectares of foreshore).", and

(e) by repealing the description of Skagit Valley Park and substituting the following:

SKAGIT VALLEY PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Yale Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 5 Tube 2029. The whole park containing approximately 28 000 hectares.

4 Schedule D is amended

(a) by repealing the name of Enderby Cliffs Park and substituting the following:

TPLAQÍN / ENDERBY CLIFFS PARK ,

(b) by repealing the description of Maquinna Marine Park and substituting the following:

NISM?AAKQIN PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Clayoquot District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 2 Tube 2029. The whole park containing approximately 2 563 hectares (1 194 hectares of upland and 1 369 hectares of foreshore). , and

(c) by repealing the description of Wells Gray Park and substituting the following:

WELLS GRAY PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Kamloops Division, Yale District, Lillooet District and Cariboo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 7 Tube 2029. The whole park containing approximately 540 448 hectares.

Rescission of ecological reserves

5 The following are rescinded:

(a) the establishment of Columbia Lake Ecological Reserve by Order in Council 1582/71, and the amendment of Columbia Lake Ecological Reserve by Order in Council 2095/72;

(b) the establishment of Fraser River Ecological Reserve by Order in Council 660/77;

(c) the establishment of Nechako River Ecological Reserve by Order in Council 3765/75;

(d) the establishment of Parker Lake Ecological Reserve by Order in Council 1829/73;

(e) the establishment of Race Rocks Ecological Reserve by Order in Council 692/80;

(f) the establishment of Skagit River Rhododendrons Ecological Reserve by Order in Council 2318/81;

(g) the establishment of Tacheeda Lakes Ecological Reserve by Order in Council 3276/72;

(h) the establishment of Vance Creek Ecological Reserve by Order in Council 466/72.

6 This Act comes into force on the date of Royal Assent.
