 Explanatory Notes

CLAUSE 1: [Transportation Act, section 1] amends the definition of "highway".

CLAUSE 2: [Transportation Act, section 68 (6)] adds an additional circumstance in which a vehicle or thing on a provincial public highway may be seized.

TRANSPORTATION AMENDMENT ACT, 2023

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:


1 Section 1 of the Transportation Act, R.S.B.C. 2004, c. 44, is amended in the definition of "highway" by striking out "means a public street, road, trail, lane, bridge, trestle, tunnel, ferry landing, ferry approach, any other public way or any other land or improvement that becomes or has become a highway by any of the following:" and substituting "means a public street, road, trail, lane, bridge, trestle, tunnel, ferry landing, ferry approach, any other public way or any other land or improvement that becomes or has become a highway by any of the following, and, in Division 3 of Part 5 of this Act, includes the boulevard, pullout, ditch or shoulder of any of them:".


2 Section 68 (6) is repealed and the following substituted:

(6) Without limiting subsection (5), the minister and any peace officer or member of the Provincial police force or a municipal police department may seize any vehicle or thing on a provincial public highway if

(a) the vehicle interferes with the normal flow of traffic on the provincial public highway,

(b) the vehicle interferes with the maintenance of the provincial public highway by equipment for that purpose,

(c) the vehicle or thing is causing, or might cause, a danger or inconvenience to persons using the provincial public highway, or

(d) the vehicle or thing may have a detrimental effect on the surrounding environment if not promptly removed.

Commencement

3 This Act comes into force on the date of Royal Assent.
