HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Administrative Tribunals Act

1 Section 10.2 (7) of the Administrative Tribunals Act, S.B.C. 2004, c. 45, is amended by striking out "he or she" and substituting "the executive chair".

2 Section 10.3 (7) is amended by striking out "he or she" and substituting "the tribunal chair".

3 Section 10.6 (3) and (4) is amended by striking out "his or her" and substituting "the individual's".

Adoption Act

4 Section 1 (1) of the Adoption Act, R.S.B.C. 1996, c. 5, is amended in paragraphs (d) (ii) and (e) of the definition of "Indigenous child" by striking out "considers himself or herself to be" and substituting "considers themselves to be".

5 Section 62 (3) is amended by striking out "his or her" and substituting "the director's".

6 Section 70.1 is amended by striking out "exercise his or her powers or perform his or her duties" and substituting "exercise powers or perform duties".

Animal Health Act

7 Section 10 (3) of the Animal Health Act, S.B.C. 2014, c. 16, is amended by striking out "his or her" and substituting "the operator's".

13 Section 4 (1) of the Armoured Vehicle and After-Market Compartment Control Act, S.B.C. 2010, c. 8, is amended

(a) in paragraph (b) by striking out "he or she" and substituting "the applicant or permit holder", and

(b) in paragraph (c) by striking out "his or her" and substituting "the permit holder's".

14 Section 6 (c) is amended

(a) in subparagraphs (ii) and (iv) by striking out "his or her" and substituting "the permit holder's", and

B.C. Rail Benefits (First Nations) Trust Act

21 Section 4 of the B.C. Rail Benefits (First Nations) Trust Act, S.B.C. 2004, c. 58, is amended

(a) by repealing subsection (1) and substituting the following:

(1) The directors of the B.C. Rail Benefits (First Nations) Trust are,

(a) for each first nation that is a Beneficiary First Nation, the chief of the first nation or the chief's designate, or, if the first nation does not have a chief, the individual acting in that capacity for the first nation or the individual's designate, and

(b) for each treaty society that is a Beneficiary First Nation, the executive director of the treaty society or the executive director's designate, or, if the treaty society does not have an executive director, the individual acting in that capacity for the treaty society or the individual's designate. , and

(b) in subsection (2) by striking out "he or she" and substituting "the director".

22 Section 6 is amended by striking out "his or her" and substituting "the director's".

Body Armour Control Act

23 Section 5 (1) of the Body Armour Control Act, S.B.C. 2009, c. 24, is amended

(a) in paragraph (b) by striking out "he or she" and substituting "the applicant or permit holder", and

(b) in paragraph (c) by striking out "his or her" and substituting "the".

24 Section 7 (a), (b) and (c) is amended by striking out "his or her" wherever it appears and substituting "the permit holder's".

British Columbia Railway Act

25 Section 32 (1) of the British Columbia Railway Act, R.S.B.C. 1996, c. 36, is amended by striking out "his or her" and substituting "the director's".

26 Section 52 (11) is repealed.

British Columbia Transit Act

27 Section 4 (3) of the British Columbia Transit Act, R.S.B.C. 1996, c. 38, is amended by striking out "his or her" and substituting "the chief executive officer's".

28 Section 25 is amended

(a) in subsection (9) by striking out "his or her" and substituting "the person's", and

(b) in subsection (10) by striking out "his or her" and substituting "the member's".

29 Section 28 (3) is amended by adding "electronic mail," after "telegraph,".

Budget Transparency and Accountability Act

30 Section 4 (5) of the Budget Transparency and Accountability Act, S.B.C. 2000, c. 23, is repealed and the following substituted:

(5) A person who is a member and who is identified in the appointment order by reference to the person's position in an organization ceases to be a member if the person ceases to hold that position in that organization.

31 Section 4.1 (6) is repealed and the following substituted:

(6) A person who is a member and whose appointment to the committee depends on the person holding a specified position in an organization ceases to be a member if the person ceases to hold that position in that organization.

Building Act

32 Section 29 (5) of the Building Act, S.B.C. 2015, c. 2, is amended by striking out "his or her" and substituting "the registrar's".

Business Corporations Act

33 Section 107 (3) of the Business Corporations Act, S.B.C. 2002, c. 57, is amended by striking out "his or her" and substituting "the shareholder's".

34 Section 126 (c) is amended by striking out "he or she" and substituting "each former director".

35 Sections 128 (1) (a) (ii) and 157 (1) are amended by striking out "his or her" and substituting "the director's".

(a) by repealing subsection (2) and substituting the following:

(2) The commissioner and any deputy commissioner in whom a beneficial interest referred to in subsection (1) is or becomes vested must divest the beneficial interest within 3 months after the later of

(a) the appointment or hiring, as the case may be, of the commissioner or deputy commissioner, and

(b) the acquisition of the beneficial interest by the commissioner or deputy commissioner. , and

(b) in subsection (4) by striking out "divest himself or herself of that interest" and substituting "divest that interest".

61 Section 70 (2) is amended by striking out "his or her" and substituting "their".

62 Section 40 of the College and Institute Act, R.S.B.C. 1996, c. 52, is amended

Commercial Tenancy Act

(b) provide to the registered member's governing body a criminal record check authorization or a criminal record check verification authorization, as applicable, at least once every 5 years after the date on which the registered member provided to the governing body the registered member's last criminal record check authorization or criminal record check verification authorization. , and

(b) in subsection (3) by striking out "his or her" and substituting "the registered member's".

154 Sections 16 (2) and 17 (3) are amended by striking out "his or her" and substituting "the registered member's".

Service

133 (1) Anything that under this Act must be given to or served on an individual may be given or served

(a) by leaving it with the individual,

(b) by sending it by registered mail to the last known address of the individual, or

(c) by sending it by electronic mail to the last known electronic mail address of the individual used in relation to a registration, permit, approval, order, waste management plan, inspection or investigation under this Act.

(2) Anything that under this Act must be given or served on a corporation may be given or served

(a) by leaving it with any director, senior officer, liquidator or receiver manager of the corporation,

(b) by sending it by registered mail as follows:

(i) if the corporation is a company within the meaning of the Business Corporations Act, to the mailing address shown for the registered office of the corporation in the corporate register;

(ii) if the corporation is an extraprovincial company within the meaning of the Business Corporations Act,

(A) to the mailing address shown in the corporate register for the head office of the corporation if the head office is in British Columbia, or

(B) to the mailing address shown in the corporate register for any attorney of the corporation;

(iii) in all other cases, to the head office of the corporation, or

(i) of the corporation or of a director, officer or employee of the corporation, and

(ii) used in relation to a registration, permit, approval, order, waste management plan inspection or investigation under this Act.

(3) Anything sent by registered mail for the purposes of this Act is deemed to be received by the person to whom it is addressed on the 14th day after deposit with Canada Post, unless the person received actual service before that day.

(4) Anything sent by electronic mail for the purposes of this Act is deemed to be received by the person to whom it is addressed on the third day after it is sent.

(5) This section does not apply to notices or documents of the appeal board.

(3) A resolution under this section that is approved by the required number of directors by telephone or any other means of communication and that is confirmed in writing or other graphic communication is as valid and effectual as if it had been passed at a meeting of the directors properly called and constituted.

(2) By the order of the court, the infant, the infant's guardian or a person appointed by the court in the place of the infant may by deed surrender the lease and accept, in its place and for the benefit of the infant, a new lease of the premises comprised in the lease surrendered for the number of lives or for the term of years as provided in the lease surrendered, or otherwise, as the court directs.

(A) to the mailing address shown in the corporate register for the corporation if that head office is in British Columbia, or

(B) to the mailing address shown in the corporate register for any attorney of the corporation;

(iii) in all other cases, to the head office of the corporation, or

(i) of the corporation or of a director, officer or employee of the corporation, and

(ii) used in relation to a licence, permit, certificate, pesticide use notice, order, inspection or investigation under this Act.

(4) Anything sent by electronic mail for the purposes of this Act is deemed to be received by the person to whom it is addressed on the third day after it is sent.

(5) This section does not apply to notices or documents of the appeal board.

(d) by repealing the definition of "lockout" and substituting the following:

"lockout" includes the closing of a place of employment, a suspension of work or a refusal by an employer to continue to employ a number of the employer's employees, done to compel the employees or to aid another employer in compelling that employer's employees to agree to conditions of employment; .

(e) drives and operates the motor vehicle only until completion of the repair referred to in paragraph (a).

(1) Except when a motor vehicle is let for hire to a corporation, a person carrying on the business of letting motor vehicles for hire without drivers must not let a motor vehicle for hire without first doing both of the following:

(a) ascertaining by inspection of a licence or permit produced by the person to whom the motor vehicle is let that that person holds

(i) a subsisting driver's licence under this Act for the operation of that motor vehicle, or

(3) After the notice referred to in subsection (2) has been sent, the taxes assessed in respect of the land and improvements referred to in that subsection may be recovered either from a person who is the owner or from a person who is the purchaser or tenant, or from a person who is the future owner, purchaser or tenant, saving the person's recourse against other persons but in the case of a sale, if the registered owner provides a statement to the assessor under this section showing that a deed of the land and improvements has been executed and delivered to the person who is the purchaser, the person who is the registered owner is not personally liable to pay taxes assessed after that for the land and improvements. ,

(c) in subsection (4) by striking out "the occupier taxed as if he or she were the owner" and substituting "the occupier taxed as if the occupier were the owner", and

(d) by repealing subsection (5) and substituting the following:

(5) Despite subsection (4) and section 2, if a person is an occupier of Crown property and

(a) donated it to the government,

(b) sold it to the government at a value that was, in the opinion of the Lieutenant Governor in Council, substantially less than its market value, or

(i) designated by a person who donated or sold the property to the government under paragraph (a) or (b), and

(ii) who does not pay rent or other valuable consideration in respect of that property to the person who donated or sold the property to the government under paragraph (a) or (b),

the person described in paragraph (a), (b) or (c) must not be taxed as an occupier under subsection (4) so long as the Lieutenant Governor in Council is satisfied that the person who is an occupier of Crown property qualifies under this section and the regulations.

(1) A collector may, directly or by a sheriff as agent, levy taxes due, with costs payable as between landlord and tenant, by distress, of

(a) the property for which the taxes were assessed or imposed, the personal property of the person liable to pay the taxes, or personal property in that person's possession, wherever they are found in British Columbia, or

(b) personal property found on the premises of the person liable to pay the taxes that is owned by or in the possession of another occupant of the premises and that would be subject to distress for arrears of rent due to a landlord. ,

(b) in subsection (2) by striking out "his or her" and substituting "the collector's",

(i) by striking out "him or her" and substituting "the other person",

(ii) by striking out "he or she" and substituting "the other person", and

(iii) by striking out "his or her" and substituting "that person's", and

(d) in subsection (4) by striking out "his or her" and substituting "the claimant's".

1096 Section 37 (1) is amended by striking out "his or her" and substituting "a".

1097 Section 38 is repealed and the following substituted:

Right of tenant to deduct taxes from rent

38 Unless there is a special agreement to the contrary between a tenant or occupant and a landlord,

(a) a tenant may deduct, from the tenant's rent, taxes paid by the tenant, and

(b) an occupant may deduct, from the occupant's rent, taxes paid by the occupant,

if those taxes could also have been recovered from the landlord or previous tenant or occupant.

1098 Section 40 is amended

(a) in subsection (1) by striking out "his or her" and substituting "the person's", and

(b) in subsection (5) by striking out "he or she" wherever it appears and substituting "the Surveyor of Taxes".

1099 Section 42 (1) is repealed and the following substituted:

(1) The collector must not sell property if the fee simple is in the government, but if taxes are delinquent for property so held by the government, the collector must make a final demand by notice mailed to a person who is a lessee, licensee, purchaser or other person in whose favour a lease, licence, agreement for sale, notice of acceptance of application to purchase or other record for the property has been made or issued, giving the person 3 months from the day on which the notice is mailed to pay the delinquent taxes, and giving that person notice that, if the delinquent taxes are not paid within the period, the lease, licence, agreement for sale, notice of acceptance of application to purchase or other record may be cancelled.

Tobacco and Vapour Products Control Act

Passing of trustee's accounts

99 (1) Subject to subsections (3), (4) and (7), an executor, administrator, trustee under a will and judicial trustee must

(a) within 2 years from the date of the grant of probate or the grant of administration or from the date of their appointment, obtain an order for passing their first accounts, and

(b) at the times the court directs, pass their subsequent accounts.

(2) Subject to subsection (3), every trustee, other than an executor, administrator, trustee under a will or judicial trustee,

(a) may, at any time, obtain from the court an order for passing the trustee's first accounts, and

(b) must, at the times the court directs, pass the trustee's subsequent accounts.

(3) Subsections (1) and (2) do not apply if

(a) the accounts are approved or consented to in writing by all beneficiaries, or

(b) the court otherwise directs.

(4) An executor, administrator and trustee, including a judicial trustee, must pass their accounts annually within one month from the anniversary of the grant of probate, of the grant of administration or of their appointment, if so required by notice served on them at the instance of a person beneficially interested in the property covered by the trust.

(5) Despite subsection (4), the court may, on application, make an order it considers proper as to the time and manner of passing the accounts.

(6) If an executor, administrator or trustee fails to pass any accounts under this section or if the executor, administrator or trustee's accounts are incomplete or inaccurate,

(a) the executor, administrator or trustee may be required to attend before the court to show cause why the account has not been passed or a proper proceeding in connection with it taken, and

(b) proper directions, including the removal of a trustee and appointment of another and payment of costs, may be given at chambers or by adjournment into court.

(7) Subsections (1) and (2) do not apply to

(a) the Public Guardian and Trustee, if appointed under Division 11 of Part 6 of the Wills, Estates and Succession Act, and

(b) any executor, administrator or trustee under a will if the date of the grant of probate or grant of administration or of the appointment of the executor, administrator or trustee is before May 1, 1949.

Unclaimed Property Act

1145 Section 5.1 (4) of the Unclaimed Property Act, S.B.C. 1999, c. 48, is amended by striking out "his or her" and substituting "the claimant's".

Union of British Columbia Municipalities Act

Wildlife Act

1174 Section 17.1 (3) of the Wildlife Act, R.S.B.C. 1996, c. 488, is repealed and the following substituted:

(3) A person commits an offence if the person

(a) is 18 years of age or older,

(b) is accompanied by another person who is under 18 years of age and who is carrying a firearm, and

(i) does not hold a hunting licence other than an initiation hunting licence and is not exempted from holding a hunting licence, or

(ii) does not meet the prescribed qualifications.

(3.1) Subsection (3) does not apply if the younger person is accompanied by and under the close personal supervision of a person, other than the person described in subsection (3), who

(a) is 18 years of age or older,

(b) holds a hunting licence other than an initiation hunting licence or is exempted from holding a hunting licence, and

Wills, Estates and Succession Act

1176 Section 1 of the Wills, Estates and Succession Act, S.B.C. 2009, c. 13, is amended in the definition of "spousal home" by striking out "his or her" wherever it appears and substituting "the person's".

(2) The court must not grant or reseal probate or administration in respect of the estate of a Nisga'a citizen unless, in addition to satisfying the requirements under subsection (1),

(a) the applicant certifies that the applicant has

(i) mailed or delivered a notice of the application to the Nisga'a Lisims Government, and

(ii) if the deceased Nisga'a citizen left a will and the Nisga'a Lisims Government requested a copy of it within 30 days of receiving the notice under subsection (1) (a), mailed or delivered a copy of the will to the Nisga'a Lisims Government, or

(b) the applicant's lawyer certifies that the applicant's lawyer has

(i) mailed or delivered a notice of the application to the Nisga'a Lisims Government, and

(b) by repealing subsection (4) and substituting the following:

(4) If a treaty first nation has standing under section 14 (3) in a judicial proceeding, the court must not grant or reseal probate or administration in respect of the estate of a treaty first nation member of the treaty first nation unless, in addition to satisfying the requirements under subsection (3),

(a) the applicant certifies that the applicant has

(i) mailed or delivered a notice of the application to the treaty first nation, and

(ii) if the deceased treaty first nation member left a will and the treaty first nation requests a copy of it within 30 days of receiving the notice under subsection (3) (a), mailed or delivered a copy of the will to the treaty first nation, or

(b) the applicant's lawyer certifies that the applicant's lawyer has

(i) mailed or delivered a notice of the application to the treaty first nation, and

1194 Section 265 of the Workers Compensation Act, R.S.B.C. 2019, c. 1, is amended

(1) Despite anything contained in any other Act, the following amounts due by an employer to the Board or, if an assignment has been made under subsection (7), to its assignee constitute a lien in favour of the Board or its assignee:

(a) an amount due on an assessment made under this Act;

(b) an amount which an employer is required to pay to the Board under this Act;

(1.1) A lien described in subsection (1) is payable in priority over all liens, charges or mortgages of every person, whenever created or to be created, with respect to the property or proceeds of property, real, personal or mixed, used in or in connection with or produced in or by the industry with respect to which the employer was assessed or the amount became payable.

(1.2) Subsection (1.1) does not apply in respect of the following:

(a) liens for wages due to workers by their employer;

(b) liens under section 50 (1) of the Temporary Foreign Worker Protection Act. ,

(b) in subsection (3) by striking out "subsection (1)" and substituting "subsection (1.2) (a)", and

Youth Justice Act

1195 Sections 7 (2), 30, 34 (7) (a) and 35 (2) (b) (iii) of the Youth Justice Act, S.B.C. 2003, c. 85, are amended by striking out "his or her" and substituting "the young person's".
